Hoffacker, defendant, was awarded a verdict by direction of the court yesterday in the sutt against him by John S. Hershey for the recovery of $6,500, the balance of purchase money due on properties 3 308 and 310 Abbottstown street, Hanover. Judge Wanner held that the uncon. tradicted evidence showed the title of Mr. Hershey to be unmarketable because of the possibility of the assertion of claims by the heirs of George Hershey against Mr.

Hoffacker should he be compelled to take the properties. Judge Ross yesterday entered a non- against the First National of Hanover in its suit to recover $4,300 from Charles J. Delone. The court ruled that the bank failed to show sufficient legal evidence to make Mr. Delone personally liable upon the notes of the S.

L. Johns Cigar company. The trial of Harry Finfrock's suit agair st the Northern Central Railway company to recover damages for personal injuries at the bands of Special Officer Frederick Borman, was begun before Judge Wanner and a jury yesterday. The plaintiff was arrested in the spring of 1913, by Borman, a duly commissioned railroad policeman, for disorderly conduct and train jumping. The arrest is claimed to have been instigated by Bert Geiselman, baggage master, who had an altercation with Finfrock two other alleged train jumpers before Gorman appeared on the scene.

Finfrock was roughly han. dled, and on the way to the jail was hit the head by Borman and felled the ground. This is the second trial of this case, the first verdict having been reversed by the superior court and a new trial ordered. The principal question involved is whether Borman acted in the line of his duty, while the assault was made, and whether the company is responsible for his acts. McClann Stock and James G.

Glessner appear for the plaintiff and Cochran, Williams and Kain for the defendant. WILL DECIDE TIES IN. PRIMARY ELECTION At the meeting of the county commissioners this morning at 10 o'clock cast decide party nominations for various district offices for which the votes -were cast at the September primaries. In addition to deciding these tie votes the county commissioners will receive bids and award a contract for printing of the official and specimen ballots for the general election next month, and also award a contract for the construction of a forced concrete bridge aver the west branch of the Codorus creek on the road from Sinsheim to Brodbeck, between the townships of Codorus and Manheim.
